General Terms and Conditions of Use: "my Visa" Website

1.  General

i. The Internet website: www.my.visabg.com ("Site") is made available to you ("You", "Your" to be interpreted accordingly) by Visa Europe (Bulgaria) EOOD, a private limited company incorporated in Bulgaria (company number UIC 207324754) whose registered office is at Landmark Building, 14 Tsar Osvoboditel Blvd. 5th floor, Sofia, Bulgaria, postal code 1000 ("Visa").

ii.These General Terms and Conditions of Use ("Terms") govern Your access to and use of the Site, including its content and functionality.

2.  Definitions

2.1 Capitalisedterms used in these Terms and not defined herein shall have the following meanings:

      a. "Account" means the unique user account created and required to access the Site;

      b. "Additional Benefits" means any additional benefits which are: (i) not Visa Card Benefits; (ii) listed on the Site; and (iii) provided to You by, and are the responsibility of, a third party, and not Visa (or an affiliate or partner thereof); 

      c. "Benefits" means the Visa Card Benefits and/or the Additional Benefits, as applicable;

      d. "Eligible Visa Card" means a valid Visa card, issued in the Territory, the use of which renders You eligible to use the Site;

      e. "Privacy Policy" means Visa's Global Privacy Notice available at: https://www.visa.co.uk/legal/global-privacy-notice.html;

      f. "Territory" means Bulgaria; and

      g. "Visa Card Benefits" means any benefits which are: (i) not Additional Benefits; (ii) listed on the Site; and (iii) provided to You by Visa or an affiliate or partner thereof.

3.  Acceptance of these Terms

       In creating an Account for, accessing, or using the Site, You hereby acknowledge that You have read, understood and agree to be bound by these Terms.

4.  Modification of these Terms

4.1 Except as prohibited by applicable law, Visa may vary these Terms at any time and for any reason. Visa shall provide You with at least thirty (30) days' prior notice of any modifications to the Terms by: (i) posting the revised Terms on the Site, and (ii) contacting You to inform You of the changes.

4.2 You are free to reject any modifications to the Terms and/or to request termination of Your Account. If You reject the modified Terms, Visa reserves the right to immediately terminate Your Account. If you request termination of Your Account, Visa shall immediately terminate Your Account. 

5.   The Site

5.1 To access and use the Site, You must create an Account in accordance with Clause 6.1 (Creating Your Account) below.

5.2 You may not access or use the Site if You are prohibited from receiving products, services, or software from Visa or any relevant third party in the Territory, whether under applicable law or otherwise.

5.3 Visa reserves the right, in its absolute discretion, to: (i) suspend; (ii) modify in any way; (iii) limit or prohibit access to; or (iv) close the Site, at any time. Notwithstanding the foregoing, if Visa closes the Site, it will give You thirty (30) days' notice of its intention to do so.

6.   Managing Your Account

6.1  Creating your account

      (a) To be eligible to create an Account, You must: (i) hold an Eligible Visa Card; and (ii) be at least eighteen (18) years old, or have authorisation from Your legal representative to access and use the Site.

      (b) To create Your Account, You must:

          (i) be connected to the Internet on a device which can access the Site;

          (ii) click the "Create my Account" button on the Site and follow the steps outlined below:

               A. enter the Your requisite information;

               B. choose Your email address and password ("Login Credentials"); 

               C. accept these Terms; 

               D. confirm that You are acquainted with the Privacy Policy; and

               E. if You wish, subscribe to the Visa newsletter; and

          (iii) validate Your registration by clicking on the registration confirmation link that You will receive by email, at the email address You provided.

6.2 Verifying Your Account

      (a) You shall provide any additional information requested by Visa in order to verify the quality or accuracy of the information provided by You. Failure to do so may result in Visa refusing the creation of, suspending access to, or deleting Your Account. Visa shall notify You if it takes any of these actions.

6.3 Accessing Your Account

     (a) To access Your Account, click the "Log In" button on the Site and enter Your Login Credentials. 

     (b) If Your Eligible Visa Card is lost, stolen, or damaged, You can find useful information in the "My Cards" tab on the Site.

6.4 Modifying Your Account

     (a) You may modify Your Account by clicking on the "My Account" tab on the Site and making the necessary changes. Potential modifications include: (i) updating Your personal information; (ii) updating Your Login Credentials; (iii) managing Your favourites and interests; and (iv) manage Your subscription to the Visa newsletter.

     (b) You may add additional Eligible Visa Cards to Your Account by clicking on the "My Cards" tab on the Site and following the steps outlined. 

6.5 Deleting Your Account

     (a) You may delete Your Account at any time by clicking the "My Account" button on the Site, selecting "Delete my Account" and following the steps outlined.

7.  Visa Card Benefits

Through Your Eligible Visa Card, You may be eligible to receive a range of Visa Card Benefits, which may be displayed on the Site.

8.  Additional Benefits

8.1 Through Your Eligible Visa Card, You may be eligible to receive a range of Additional Benefits. These Additional Benefits are provided by, and are the sole responsibility of, the third party which provides them to You (each a "Third-Party Benefit Provider").

8.2 Visa does not provide the Additional Benefits and is not liable for or in any way responsible for their provision to You by the relevant Third-Party Benefit Provider.

8.3 If You have complaints or questions relating to an Additional Benefit, then please contact the Third-Party Benefit Provider directly.

8.4 Additional Benefits shall be distinguishable from Visa Card Benefits by their mention of "Exclusivity".

9.  Third Part Feature

9.1 You understand and accept that the Site allows You to access, view, and/or use features, products, applications, and Benefits (including all Additional Benefits) belonging to or provided by third parties and not Visa (each a "Third-Party Feature").

9.2 Third-Party Features are: (i) subject to separate conditions of use, licenses, policies, and other documentation; and (ii) contracted for between You and the relevant third party, and not Visa. 

9.3 You understand and accept that, in order to use a Third-Party Feature, You must adhere to its conditions of use.

9.4 To the extent that You have a complaint, issue, or question relating to any Third-Party Feature (including an Additional Benefit), You should contact the relevant third party who provides that Third-Party Feature, and not Visa.

9.5 Visa is not responsible or liable to You for any losses, expenses, or costs arising out of or in relation to any Third-Party Feature.

10.  Third-Party Sites via Hypertext Link

10.1 The Site may present hypertext links to other third-party sites independent of the Site. Visa is not responsible for the accuracy, integrity, or reliability of the content of such third-party sites, or the products or services (including any Additional Benefits) offered or sold through such third-party sites.

10.2 The existence of a link on the Site to a third-party site does not imply validation of that site or its content by Visa.

10.3 Your connection to these third-party sites and their use are Your sole responsibility.

11.  Privacy

11.1 Visa shall process Your personal information in accordance with its Privacy Policy.

11.2 You warrant that the personal information You provide to Visa is accurate, up-to-date, and complete.

12.  Your Obligations

You understand and accept that:

(a) You shall not create more than one (1) Account;

(b) You shall keep Your Account and Login Credentials strictly confidential;

(c) You shall immediately notify Visa if You become aware of any unauthorised access to or use of Your Account;

(d) You are responsible for all acts or omissions taken in respect of Your Account, unless such act or omission is beyond Your control, such as hacking; 

(e) You shall not use or misuse the Site in any way, including but not limited to taking actions which would put You or Visa in breach of applicable law, or infringe the rights of a third party; and

(f) You are responsible for the costs and risks associated with Your access to the Internet and the Site, including but not limited to data loss, equipment and other damage, viruses and other malware.

13.  Visa Obligations

Visa shall use commercially reasonable efforts to provide access to the Site at all times, excluding where: (i) a force majeure or other event beyond Visa's reasonable control prevents this, or (ii) updates to and/or maintenance of the Site take place.

14.  Liability

Visa's Liability

14.1 To the fullest extent permitted by applicable law, Visa shall:

       (a) not be liable for:

           (i) any direct or indirect losses or damages of any kind arising out of or in relation to:

               A. Your use or operation of the Site, including any subsequent receipt or use of the Benefits;

               B. any interruption to all or any part of the Site or Your access to the Internet, regardless of cause, duration, or frequency;

               C. any interruptions, breakdowns, modifications, or malfunctions relating to the Site;

                D. any difficulty or impossibility in accessing the Site;

                E. a force majeure event; and

                F. any other event not under Visa's sole control;

           (ii) the provision, receipt, quality, content, or function of any Benefits provided by a third party;

           (iii) fraudulent or unauthorised use of Your Account due to Your failure to keep 
Your Login Credentials confidential; and

          (iv) the acts or omission of a third party (including any Third-Party Benefit Provider) or You; 

      (b) only be liable for direct damage suffered by You resulting from its breach of its obligations set out in this Terms.

14.2 You are fully responsible for Your use of the Site. The Site is delivered "as is" and without guarantee as to its availability, accuracy, or quality. Visa makes no warranty, express or implied, in respect of Your access to and use of the Site, including with respect to technical problems that may occur.

14.3 You hereby waive the right to claim from Visa compensation for indirect damages.

14.4 In the event that Visa is liable under these Terms, it's total liability to You shall be limited to five hundred Euros (€500).

15.  Intellectual Property

15.1 The software, structure, content, data and other materials comprising the Site, including but not limited to the logos, trademarks, images, videos, photographs, text, graphic elements, software, and other elements comprising the Site ("Content") are protected by copyright, trademark, patent, or other intellectual property rights and are the exclusive property of Visa, and relevant third parties (each a "Rights Holder"). 

15.2 Any access to or use of the Content not expressly authorised either: (i) by these Terms, or (ii) in writing by the applicable Rights Holder, shall constitute an infringement of intellectual property of Visa or the relevant Rights Holder. You understand and accept that such infringement may give rise to criminal or civil liability.

15.3 You shall not copy, modify, reproduce, distribute, publish, adapt, assign, license, give warranty over, transmit, integrate into other media, reverse engineer, or access the source code or protocols of the Site, or any Content, without prior written authorisation from Visa and any applicable Rights Holders.

16.  Governing Law; Jurisdiction

16.1 These Terms shall be governed by and construed in accordance with the laws of Bulgaria. 

16.2 You irrevocably agree that the competent courts of Bulgaria shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).

16.3 Each of the provisions of these Terms is severable.  If any provision of these Terms is or becomes illegal, invalid or unenforceable under the law of any jurisdiction, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law.  The remaining provisions of these Terms shall remain in full force and effect.
